After examination of the record, this panel agrees unanimously that oral argument is not needed. Rule 34(a), Federal Rules of Appellate Procedure. Plaintiff appeals the district court's sua sponte dismissal of his civil rights complaint which was filed pursuant to 42 U.S.C. ร§ 1983. The substance of plaintiff's complaint is that defendant Ellis, a Franklin County, Ohio prosecutor, refuses to prosecute witnesses who testified at plaintiff's criminal trial. Plaintiff alleges the witnesses committed perjury at his trial.
